Is off-plan property in Dubai safe? Escrow, explained properly.

The short answer: yes — provided you buy from a registered developer and understand the legal framework protecting your money. This guide walks through Dubai's regulatory architecture, how mandatory escrow accounts work, what your SPA guarantees, and exactly what to do if something goes wrong.

How Dubai regulates off-plan: RERA and the DLD

The cornerstone is Law No. 8 of 2007, which requires every off-plan developer to register the project with the DLD before selling, open a dedicated escrow account per project, obtain a marketing permit, and hit defined construction milestones before drawing funds. RERA — the DLD's regulatory arm — licenses developers and brokers, approves projects, investigates complaints, and can cancel projects, appoint trustees and mandate refunds.

How the escrow account actually works

Your money never goes to the developer's operating account. It goes into a project-specific escrow account at a DLD-approved bank. Withdrawals are only permitted at verified construction milestones, confirmed by a DLD-registered independent engineer — foundations, structural completion, superstructure, fit-out, and final release at handover and registration. Your payment is always tied to physical progress, not the developer's cash-flow needs.

  1. You sign the SPA and pay — deposit and instalments go to escrow, not the developer.
  2. DLD registers the transaction — a legal record of your ownership interest (Oqood).
  3. Construction proceeds — an independent consultant verifies completion percentages.
  4. Milestone verified → tranche released — only after verification.
  5. Handover — final release; your title deed is issued and registered in your name.

Be clear-eyed: escrow doesn't guarantee 100% recovery where construction has legitimately consumed funds — but it dramatically reduces exposure versus unprotected markets. It's also why developer selection is the single biggest safety lever you control.

Can a developer legally cancel my contract?
