
A delayed handover is stressful — but you are far from powerless. Dubai has some of the most structured buyer-protection laws in the region. Honestly: not rare. A significant proportion of Dubai off-plan projects have seen handover pushed back six months or more at some point in their construction cycle. Context matters though — three months of supply-chain slippage is very different from a two-year stall with no credible timeline. Causes include supply chain disruption, permitting or design amendments, developers slowing construction when sales underperform, financial strain, and force majeure.
Every DLD-registered SPA includes a projected handover date — and almost universally a grace period clause, typically 12 months beyond it. The developer is not legally in breach until that grace period expires. Handover 31 Dec 2025 means remedies trigger around 31 Dec 2026. Once it lapses, the SPA typically activates: delay penalty compensation (if stipulated), RERA escalation rights, and in certain cases rescission and refund.
With a penalty clause: a contractual right to the specified per-day or per-month amount once the grace period expires. Without one: compensation isn't automatic — you must evidence actual loss (alternative rent paid, documented lost income). Rescission: if RERA cancels the project or a court orders rescission, you're refunded escrow-held amounts; recovering funds already released against milestones can require court enforcement.
